Genuine Redundancy

Under the FW Act, a genuine redundancy occurs when:

  • the employee’s employment is terminated because the employer no longer requires anyone to do the job due to changed operational requirements;
  • the employer has complied with any consultation requirements outlined in an applicable modern award or enterprise agreement; and
  • it was not reasonable in all the circumstances for the employer to redeploy the employee within its own enterprise or that of an associated entity.
