Protected Industrial Action

Protected industrial action is industrial action permitted by the Fair Work Act 2009 (Cth). It attracts a legal immunity for those persons organising or engaging in it, meaning that (except in certain circumstances) persons adversely affected by the action cannot:

  • bring legal action to prevent it from happening; or
  • seek compensation for any loss or harm suffered.
