Serious Breach Declaration

The Fair Work Commission (FWC) may issue a serious breach declaration if a party seriously or grossly breaches the terms of a bargaining order. In the case of a serious breach declaration, the FWC will take over the bargaining process and decide matters that the parties have not already agreed on.
