Can we offer a lower rate of pay during a worker’s probationary period?
Can we pay a new employee, who has commenced work on a probationary period, at a lower pay rate, and if they pass the probationary period their pay rate will increase?
There’s nothing stopping you from having a conversation with the employee about their rate of pay – and coming to an agreement. However, you cannot alter the remuneration of the employee without their consent – though it seems unlikely that an employee would not consent to having their pay increased.
