What is the maximum number of hours an employee can work? We have an employee who has just been given a contract for 12 hour days for 12 day fortnights for 6 week periods followed by 2 weeks off. Is that legal?
We operate under an Enterprise agreement which states ordinary hours are 40 hours per week
The interpretation of an enterprise agreement is beyond the scope of the Helpdesk service.
However, without reading the enterprise agreement based on the information you have provided any additional hours your employee is required to work in excess of the ordinary 40 hours per week will likely be considered overtime and attract the overtime rates provided in the enterprise agreement.
