The Case

Trika v Home@Scope Pty Ltd (2022)

Home@Scope Pty Ltd (HScope) employed Mr Trika as a disability support worker. HScope launched an investigation into allegations that Mr Trika had engaged in misconduct by:

  • refusing to assist a work colleague;
  • leaving his shift early, resulting in another work colleague having to care for five clients alone; and
  • engaging in inappropriate and restrictive practices, such as:
    • not allowing a client to leave her room for a cup of tea;
    • not allowing clients to watch TV or listen to music; and
    • restricting clients to their bedrooms until 7am.
