Business awarded $500,000 in damages for manager’s breach of post-employment restraints

AEI Insurance Group Pty Ltd v Martin (No 4) (2024)

AEI Insurance Group Pty Ltd (AEI) employed Mr Martin as an account manager for 11 years. Mr Martin was responsible for growing AEI’s business in Queensland and was a key contact for clients for claims assistance after hours. 

Mr Martin’s employment contract contained post-employment restraints, which required him to:

  • return the 24/7 emergency assistance phone;
  • not copy or use AEI’s confidential information; and
  • not work with any client of AEI with whom he had dealings or influence for 12 months post-termination.
