Demotion found to be in response to poor performance in general protections claim

The Case

Nuttall v Hatch Pty Ltd (2024)

Hatch Pty Ltd employed Mr Nuttall as its Manager of Infrastructure. In February 2018, Mr Nuttall was demoted to the position of Structures Team Lead due to performance issues. The Managing Director sent an email to Mr Nuttall’s team outlining the new organisational structure.

Mr Nuttall commenced general protections proceedings, alleging that Hatch had taken adverse action against him because he had made numerous workplace complaints, including complaints about the Managing Director.
