Failure to properly consult causes redundancy headaches

The Case

Khliustova v Isoton Pty Ltd (2023)

Isoton Pty Ltd (Isoton) employed Ms Khliustova as a software engineer. Due to financial issues, Isoton undertook a restructure and in doing so made Ms Khliustova’s position redundant.

Ms Khliustova was notified of the redundancy via an online audio-visual meeting and the employment termination was then confirmed by email. No consultation took place. Nor was Ms Khliustova offered alternative employment. Isoton’s related entity had positions available in India.
