Full Bench of the FWC upholds employer’s refusal of a flexible work arrangement

The Case

Quirke v BSR Australia Ltd (2023)

A BSR Australia Ltd employee, Ms Quirke, sent a request to her manager for a flexible work arrangement. Ms Quirke submitted, by email, a sample roster that she claimed was in line with her doctors’ recommendations.

BSR Australia verbally refused the request.

Ms Quirke made an application to the Fair Work Commission (FWC) challenging the refusal.
