The Case

Moro v Insider AU Pty Ltd (2023)

Insider AU Pty Ltd employed Mr Moro as a sales representative. Insider permitted its employees to work flexibly from home, provided they attend the office 2 days per week. Despite this, Mr Moro failed to attend the office on a number of mandatory in-office work days. Mr Moro received informal counselling for his non-attendance.

On 30 August 2023, Mr Moro did not attend for work on a mandatory office day. Mr Moro indicated on his work calendar that he would be working from home. When spoken to by his manager, Mr Moro advised he had worked from home due to a tradesperson attending to fix his dishwasher.
