Interim order prevents dismissal of Chief Executive Officer

The Case

Dabboussy v Australian Federation of Islamic Councils (2024)

Mr Dabboussy commenced employment as Australian Federation of Islamic Councils (AFIC) Chief Executive Officer on 4 September 2023 and was summarily dismissed on 3 September 2024. This was 1 day short of the unfair dismissal claim 12-month qualifying period.

AFIC claimed Mr Dabboussy’s summary dismissal was justified following an investigation into sexual harassment. For the investigation, Mr Dabboussy was interviewed and thereafter provided with an interview transcript on 2 September 2024, which he approved on 3 September 2024. AFIC summarily dismissed Mr Dabboussy later the same day, assuming the uncompleted final investigation report would find the allegations substantiated.
