Out-of-the-blue dismissal of an accountant found to be unfair

The Case

Roberts v Drewmaster Pty Ltd (2024)

Ms Roberts was employed as the accountant at the Clive Palmer Coolum Resort, operated by Drewmaster Pty Ltd. Ms Roberts heard allegations from other employees about her employment, which distressed her, prompting her to take paid personal leave. When Ms Roberts returned to work, she found that she could not log into her work computer. A colleague informed her that her employer had decided to dismiss all employees who were not at work the day before Ms Roberts’ return.

Ms Roberts received a pay slip that documented her accrued annual leave pay out. She did not receive an employment termination letter, however, she was informed her employment had been terminated for serious misconduct.

Ms Roberts commenced unfair dismissal proceedings in the Fair Work Commission (FWC).
