Redeployment options offered to sales team leader found to be unacceptable

The Case

Sales Link Australasia Pty Ltd v Macourt (2022)

Sales Link Australasia Pty Ltd (Sales Link) employed Ms Macourt as a team leader. When Ms Macourt’s position was made redundant, Sales Link offered her two redeployment options:

  • independent key account (IKA) manager for a 6–12-month contract period, with a commute to work of 166km, on the same salary; or
  • sales representative on an ongoing basis, with no difference in commuting distance but a significant salary deduction.

Ms Macourt rejected both redeployment options, saying she did not have the requisite skills to perform the IKA manger role and the sales representative role was a demotion. Sales Link thereafter terminated Ms Macourt’s employment on the ground of redundancy.
