Referee makes adverse action claim after maximum-term contract not renewed

The Case

Alouani-Roby v National Rugby League Limited, Bernard Sutton and Graham Annesley (2022)

National Rugby League Limited (NRLL) employed Mr Alouani-Roby as an NRL football referee under a series of maximum-term contracts. His last contract commenced on 1 December 2019 and concluded on 30 November 2020. Thereafter his contract was not renewed.

Mr Alouani-Roby claimed his contract was not renewed due to adverse action taken by NRLL, Elite Officiating GM Mr Sutton and Elite Operations Head of Football Mr Annesley (collectively, the respondents) after Mr Alouani-Roby made a series of workplace complaints, including about bullying and victimisation.
