Refusal to consider pay increase showed unconscious bias

The Case

Austin Health v Tsikos (2023)

In 2010, Austin Health (AHealth) employed Ms Tsikos as the manager of its orthotic/prosthetics department. Ms Tsikos was paid at the rate set out in its enterprise agreement (EA). Ten male employees reported to Ms Tsikos. Of those 10, six were paid above the relevant EA rate. All 10 were classified at a level higher than their role under the EA and one was paid more than Ms Tsikos.

Ms Tsikos requested on seven occasions for AHealth to increase her salary. This never eventuated, with AHealth arguing the male employees’ salaries were an anomaly.
