Summary dismissal found to be a disproportionate consequence for policy breach

The Case

Angela Daddona v Menarock Aged Care Services (Shepparton) Pty Ltd (2022)

Menarock Aged Care Services (Shepparton) Pty Ltd (Menarock) employed Ms Daddona as a Food Services Assistant. In December 2021, the Aged Care Quality and Safety Commission conducted an audit of Menarock’s facility. Before the audit, Menarock reminded staff to wear their personal protective equipment.

While caring for a resident who had difficulties hearing, Ms Daddona had lowered her face mask to make communication easier. Upon leaving the resident’s room, Ms Daddona had inadvertently forgotten to pull up her mask. The auditor saw this and reported the matter.
