Taking domestic and family violence leave results in unfair dismissal

The Case

Singh v Priceline Sutherland Pty Ltd (2023)

Priceline Sutherland Pty Ltd (Priceline) employed Ms Singh as a senior pharmacy assistant. Throughout Ms Singh’s employment with Priceline, she and her 9-year-old son, for whom she had sole custody, experienced various instances of domestic violence by her former husband.

In December 2022, Ms Singh requested leave to care for her son following a domestic violence incident involving Ms Singh’s former husband. Then in early January 2023, Ms Singh left work early due to another domestic violence incident involving her son and former husband. Ms Singh then requested leave until the end of January to care for her son until he returned to school.
