Tickle gets the last laugh in transgender discrimination win

The Case

Tickle v Giggle for Girls Pty Ltd (No 2) (2024)

Roxanne Tickle, is a transgender female who underwent gender re-affirming surgery and obtained an updated Queensland female birth certificate. Ms Tickle applied to use the Giggle app, a social media platform developed by Giggle for Girls Pty Ltd (Giggle) exclusively for women. Ms Tickle was initially granted access to the app; however, this was later restricted after her uploaded photograph was reviewed.

Ms Tickle commenced proceedings against Giggle and its CEO, Ms Grover (respondents), claiming direct and indirect gender identity discrimination, in breach of the Sex Discrimination Act 1984 (Cth) (SDA).
