Underpayment of vulnerable worker attracts high pecuniary penalty

The Case

Australasian Meat Industry Employees Union v Dick Stone Pty Ltd (No 2) (2022)

Meat wholesaler Dick Stone Pty Ltd employed Ghanaian immigrant Mr Boateng from 2016 to 2019. Mr Boateng’s employment contract required him to work 50 ordinary hours each week from 2am to 11:30am on weekdays and from 2am to 7am on Saturdays, plus reasonable additional hours as required.

The Meat Industry Award 2010 applied to Mr Boateng’s employment. Mr Boateng’s employment contract did not reference the Award and he was not provided with a copy of the Fair Work Information Statement (FWIS).
