Q: We recently dismissed an employee within probation due to unsuitability. This employee had possession of some IT equipment of the business upon dismissal, and we are still awaiting its return. Can we withhold employment termination pay (i.e. pay in lieu of notice and annual leave accrual) until the return of the equipment?
