We have an employee who has worked for a day and then resigned without giving notice. Do we have to pay him for the 1 day?

If the employee worked the full ordinary hours for the day of work, you must pay him for those hours according to the agreed wage.

Some modern awards allow for deduction in the event of insufficient notice. For instance, if your employee is an IT professional, he may be covered by the Professional Employees Award. This provides that if an employee who is at least 18 years old does not give 1 month’s notice of resignation, the employer may deduct from wages due to the employee under the award an amount that is no more than 1 week’s wages.
