We have a full-time employee who has requested to reduce their work days to 3 days per week, effective immediately. The employee has indicated they will resign should we not agree to the reduction in hours. We feel that this role requires a full-time employee. For this reason, can we refuse the employee’s request?

An employee can request to vary their contracted number of hours from full-time to part-time. While it is best practice to consider whether you are able to accommodate the request, you do not need to agree to the change.

Take care if the employee has made the request due to a workplace injury, or is making a flexible working arrangement request under the Fair Work Act 2009 (Cth). In these cases, you must consider the request and can only decline on reasonable business grounds, or where you are unable to make reasonable adjustments to accommodate the employee.
